To enter this Sweepstakes, you must agree to and abide by these Official Rules (“Official Rules”).

NO PURCHASE NECESSARY TO ENTER OR WIN. A PURCHASE OR PAYMENT OF ANY KIND WILL NOT INCREASE YOUR CHANCES OF WINNING. YOU MUST HAVE INTERNET ACCESS, A VALID EMAIL ADDRESS AND AN INSTAGRAM ACCOUNT TO PARTICIPATE. ELIGIBILITY: SWEEPSTAKES OPEN ONLY TO LEGAL RESIDENTS OF THE FIFTY (50) UNITED STATES AND THE DISTRICT OF COLUMBIA, WHO ARE AT LEAST EIGHTEEN (18) YEARS OF AGE AT TIME OF ENTRY. This Sweepstakes is separate and apart from Disney Destiny Facebook Sweepstakes being offered simultaneously by Disney Destinations, LLC (“Sponsor”). Each sweepstakes promotion will feature its own prizing at separate odds of winning. The Official Rules for Disney Destiny Facebook Sweepstakes are accessible by clicking on https://sweepstakes.disneycruise.com/FacebookRules. You may enter this Sweepstakes on Instagram and the Disney Destiny Facebook Sweepstakes on Facebook. But, you may only win the prize in this Sweepstakes OR Disney Destiny Facebook Sweepstakes.

1. SPONSOR: Disney Destinations, LLC (“Sponsor”), P.O. Box 10,000, Lake Buena Vista, Florida 32830.

2. ADMINISTRATOR: Probability LLC (“Administrator”), 2 Woodstock Meadows Lane, Woodstock, NY 12498.

3. ELIGIBILITY: The Disney Destiny Instagram Sweepstakes ("Sweepstakes") is open only to legal residents of the 50 United States or District of Columbia, who are at least eighteen (18) years of age (or the age of majority in the jurisdiction of their residency, whichever is older), and who have Internet access, a valid email address and an Instagram account. Any individuals (including but not limited to employees, consultants, independent contractors, and interns) who have, within the past six (6) months prior to the start of the Sweepstakes, performed services for Sponsor, Administrator, or any organizations responsible for sponsoring, fulfilling, administering, advertising or promoting the Sweepstakes, and/or their respective parent, subsidiary, affiliated and successor companies (collectively, the “Sweepstakes Entities”), and immediate family and household members of such individuals, are not eligible to enter or win a prize. "Immediate family members" shall mean parents, step-parents, children, step-children, siblings, step-siblings, or spouses, regardless of where they live. "Household members" shall mean people who share the same residence at least three (3) months a year, whether related or not. Void where prohibited by law.

SWEEPSTAKES SCHEDULE: The Sweepstakes begins on or about 9:00 a.m. Eastern Time (“ET”) on Monday, September 1, 2025 and ends at 11:59 p.m. ET on Tuesday, September 30, 2025 (“Promotion Period”). Sponsor's computer is the official clock for this Sweepstakes.

4. SWEEPSTAKES ENTRY: 

To enter during the Promotion Period, take the following actions (each, a “Sweepstakes Entry”) and collectively, “Sweepstakes Entries”):

(a) follow @Disneycruiseline (“Disney Account”); and

(b) Posting a picture of yourself doing your best Disney Hero or Villain pose that includes the hashtag “#DisneyDestinySweepstakes (“Sweepstakes Hashtag”) in the comments section (collectively a “Post”).

Hashtag is not case-sensitive. The Sweepstakes Hashtag and picture of yourself doing your best Disney Hero or Villain pose must be included as part of your Post in order to be eligible.   

  

You may include an additional comment as part of your Post, but this is not required, nor will the inclusion of a comment in any way enhance your odds of winning a prize. If you do add a comment, all uses of the word “Post” in these Official Rules (as used in conjunction with entries) includes the accompanying comment as well.  

POST MAY NOT INCLUDE ANY MUSIC.

Your Post that includes (a) the Sweepstakes Hashtag (#DisneyDestinySweepstakes) and (b) a picture of yourself doing your best Disney Hero or Villain pose, together with a Follow, will constitute one (1) Sweepstakes Entry into this Sweepstakes.   

If you do not have an Instagram account, you can visit https://instagram.com/ or download the Instagram app on a compatible device from the iTunes App Store or Google Play and create an Instagram account according to the instructions on the website/app. Creating an Instagram account is free. Please note that you must agree to comply with the Instagram Terms of Service in order to create an Instagram account.  

  

BY POSTING A POST THAT INCLUDES THE SWEEPSTAKES HASHTAG “#DISNEYDESTINYSWEEPSTAKES”, YOU ARE INDICATING THAT YOU HAVE READ, UNDERSTOOD AND FULLY AGREE TO THESE OFFICIAL RULES. DO NOT MAKE A POST WITHOUT FIRST REVIEWING THESE OFFICIAL RULES.  

  

Partial or incomplete/piecemeal submissions via Instagram (e.g., including the Sweepstakes Hashtag but not including a picture of yourself doing your best Disney Hero or Villain pose or including a picture of yourself doing your best Disney Hero or Villain pose but not the Sweepstakes Hashtag in your Post) will NOT BE ACCEPTED.   

  

Post must be created for the sole purpose of this Sweepstakes and must be posted by the entrant. Sharing another account’s Instagram post to your own feed (i.e., known as “re-grams”) will not be a valid entry. To be eligible for the Sweepstakes, Posts must be submitted in compliance with the format and other requirements set forth by Instagram. 

Do NOT include personal information (e.g., name, e-mail address or phone numbers) about yourself or anyone else in the Sweepstakes Entry.

Once submitted, Posts become the sole property of Sponsor (subject only to the rights of Instagram), and cannot be modified by entrant. By submitting a Sweepstakes Entry, entrant gives permission to Sponsor and its designees and hereby grants Sponsor and its designees a royalty-free, irrevocable, perpetual, worldwide, sub-licensable, non-exclusive license (herein “License”) to use any portion of the Sweepstakes Entry on any media and through any means now known or hereafter devised, including without limitation, the World Wide Web, and to otherwise use the Sweepstakes Entry, and make derivative works therefrom, without compensation in accordance with the requirements of this Sweepstakes and the advertising, promotion, and publicity of the Sweepstakes, Sponsor’s products and services, and otherwise, as stated in these Official Rules (as solely determined by Sponsor). Such License will be required to be confirmed by entrant upon Sponsor’s request if entrant becomes a potential winner and in such event, entrant shall timely complete, sign and deliver any and all necessary documents, including without limitation, documents setting forth any licenses, releases and indemnities that Sponsor in its sole discretion may require, without condition or compensation of any kind. If Sponsor does not receive all such documentation from any potential winner within the prescribed timeframe, in each instance as required by Sponsor in its sole discretion, the potential winner will be disqualified and another potential winner will be selected.

Limit one (1) Sweepstakes Entry per person during the Promotion Period. Multiple entries and/or mass entry attempts (e.g., multiple Sweepstakes Entries) may result in disqualification of all Sweepstakes Entries related to such person/email address/Instagram account. Sweepstakes Entries must be manually key-stroked by the entrant; use of automated devices or programs, or Sweepstakes Entries by third parties by any method of entry, are prohibited. Sweepstakes Entries that do not conform to or that violate these Official Rules or are submitted in any manner other than as stated in these Official Rules will be disqualified. Sponsor and Administrator are not responsible for late, corrupted, garbled, inaccessible/blocked, incomplete or misdirected Sweepstakes Entries. By entering the Sweepstakes, entrant agrees to these Official Rules and the decisions of the Administrator and Sponsor, which are binding and final, in all matters relating to this Sweepstakes.

You may only use one (1) Instagram account to participate in the Sweepstakes. All Sweepstakes Entries must comply with the Instagram terms of service and Instagram rules available at the Instagram website.

Data rates may apply for each message sent or received from your wireless device according to the terms and conditions of your service agreement with your wireless carrier. Other charges may apply (such as normal airtime and carrier charges as well as charges for wireless Internet access) and may appear on your mobile phone bill or be deducted from your prepaid account balance. Wireless carriers' rate plans may vary, and you should contact your wireless carrier for more information on messaging rate plans and charges relating to your participation in this Sweepstakes. Mobile device service may not be available in all areas. Check your phone's capabilities for specific instructions.

5. SWEEPSTAKES ENTRY RESTRICTIONS/CONTENT GUIDELINES: In addition to complying with all other requirements of these Official Rules and/or on the website/platform where persons may submit Sweepstakes Entries (i.e., Instagram); each Sweepstakes Entry must comply with the following guidelines (“Content Guidelines”). Sweepstakes Entries must be original and created for the sole purpose of this Sweepstakes and must be posted by the entrant.

Participation must be effected in accordance with these Official Rules. Once submitted, Sweepstakes Entries cannot be modified or supplemented by entrant. Joint/group Sweepstakes Entries are prohibited. No Sweepstakes Entries may be made (in whole or in part) on behalf of someone else.

Sweepstakes Entries: (i) must be the original and sole creation of the entrant, and all right, title and interest including but not limited to the copyright in any Sweepstakes Entry, must be owned solely by the submitting entrant; (ii) may not infringe upon any third party’s rights, including but not limited to, copyright, patent or trademarks/tradenames/logos, or rights of privacy or publicity, or contain material that is or may be considered misleading, inappropriate, indecent, obscene, hateful, tortious, defamatory, slanderous or libelous, or portray or depict any person, product or entity in a false light*; (iii) may not violate any law, rule or regulation; (iv) may not contain any virus, bugs, or other deleterious material; (v) may not, for example but not limited to, contain content that reflects, advocates or promotes bigotry, racism, hatred, harm or exploitation of or against any class, group or individual, discrimination based on race, gender, religion, nationality, disability, sexual orientation or age, or actions or activities that are restricted, prohibited, illegal or unlawful (including without limitation, the consumption of alcohol or other controlled substances), defamatory statements, words or symbols widely considered offensive to individuals of any certain race, ethnicity, religious, sexual orientation or socioeconomic group, or threats to any person, place, business, group or world peace; (vi) may not be sexually explicit or suggestive, profane or pornographic or contain nudity; (vii) must have been created specifically for this Sweepstakes and not have been previously posted via social media or otherwise; and each entrant warrants and represents that his/her entry complies with all of those conditions. Sweepstakes Entries cannot contain, among other things, the trademark, tradename or logo of any third party or entity or product, cannot name or describe any person (living, dead, or fictional) other than the entrant, and cannot contain any material that is protected by copyright.

*Sponsor grants to each qualified entrant a limited, non-transferable, non-exclusive, non-sublicensable, revocable right to use its trademarks solely for purposes of and limited to including them in the Sweepstakes Entries; such right and license will automatically expire without further act of any party at the expiration of the Promotion Period, unless specifically extended on an individual basis by Sponsor in writing in its sole discretion. Any other use of Sponsor’s and/or its licensors’ trademarks will be a violation of Sponsor’s or its applicable licensor’s intellectual property rights. Sponsor’s items (including the trademarks) cannot be modified, adapted, or edited by entrant; the preceding only excludes modifications due to technological limitations or malfunctions.

SWEEPSTAKES ENTRIES REPRESENT SOLELY THE VIEWS/OPINIONS OF THE ENTRANT AND DO NOT REFLECT THE VIEWS/OPINIONS OF SPONSOR IN ANY MANNER. SPONSOR IS ACTING AS A PASSIVE CONDUIT FOR THE POSTING/PUBLICATION OF SWEEPSTAKES ENTRIES AND HAS NO OBLIGATION TO, AND EXPRESSLY DISCLAIMS ANY AND ALL LIABILITY IN CONJUNCTION WITH, SCREENING, MONITORING OR REVIEWING THE CONTENT OF SWEEPSTAKES ENTRIES. SPONSOR WILL NOT EDIT OR MODIFY SWEEPSTAKES ENTRIES IN CONJUNCTION WITH THE SWEEPSTAKES.

6. RANDOM DRAWING/SELECTION OF WINNERS/ODDS: Potential prize winner will be selected in a random drawing on or about one business day following the Promotion Period end date from among all eligible entries received during the Promotion Period. For the avoidance of doubt, if a Sweepstakes Entry is otherwise in compliance with these Official Rules (including but not limited to the Content Guidelines in Section 5 above), the content of the Sweepstakes Entry will NOT be taken into account in the winner selection process. The drawing will be conducted by Probability LLC, an independent judging organization/Administrator whose decisions are final and binding on all matters related to the Sweepstakes.

Odds of winning depend on the total number of eligible Sweepstakes Entries received during the Promotion Period.

7. PRIZE AND APPROXIMATE RETAIL VALUES (“ARV”):

ONE (1) PRIZE (“Prize”): Winner will receive a 4-night or 5-night Disney Cruise Line vacation (length of cruise dependent on chosen sail date) for the Winner and up to three (3) guests (each a “Guest”; collectively “Guests” and together with the Winner, the “Group”) to be taken aboard the Disney Destiny ship (the “Vacation”). The Prize consists of the following:

If Winner resides outside a 250 mile radius of the Port Everglades:

• Up to four (4) roundtrip coach airfares (with possible layovers) between the major U.S. gateway airport closest to Winner’s residence (“Departure Airport”) and Fort Lauderdale International Airport in Fort Lauderdale, FL (“Arrival Airport”);
• One (1) standard room with a maximum occupancy of four (4) persons at a hotel (hotel selection at the discretion of Disney) for one (1) night prior to the ship’s departure;
• Ground transportation for up to four (4) persons or voucher(s) for local ground transportation service from Arrival Airport to the hotel, from the hotel to Port Everglades, and from Port Everglades to the Arrival Airport (at the discretion of Disney);

The Disney Cruise Line sailing shall consist of one (1) four (4)-night or five (5)-night Cruise (length of cruise dependent on chosen sail date) on the Disney Destiny  for up to four (4) persons, consisting of:

• One (1) stateroom aboard the Disney Destiny (location/category at sole the discretion of Disney) with a maximum occupancy of four (4) people;
• All meals onboard the Disney Destiny (excluding specialty dining and fine dining);

The ARV of Prize: $12,144.00, which includes Taxes, Fees, and Port Expenses (as defined on the Disney Cruise Line website). The actual value of the Prize may vary depending on point of departure, date, times of travel, and fluctuations of rates and airfares at the time of travel booking. Therefore, the actual value of the Prize awarded may be lower or higher at the time it is fulfilled. If the actual value of the Prize is less than stated ARV, the difference will not be awarded.

See below for additional conditions and restrictions regarding the Vacation. 

Vacation must be booked at least 45 days prior to the intended travel dates and must occur between January 1, 2026 and January 1, 2027 subject to the following blockout dates: 3/28/26, 6/15/2026, 11/23/26, 12/19/2026, 12/21/2026, 12/26/2026, 12/28/2026 (blockout dates are at the discretion of Disney Cruise Line and subject to change without notice). If travel is not completed by January 1, 2027 the prize will be forfeited without compensation of any kind. Sponsor reserves the right to change the allowable travel dates, the Vacation period, cruise ship or any other component of the Vacation, for any reason and in its sole discretion. No substitution of a Vacation or any elements thereof is allowed, except at Sponsor’s sole discretion or where required by law. Ports of call, offerings and experiences onboard are subject to change, availability and cancellation without notice. Winner must provide Sponsor with three (3) possible travel dates; however, Sponsor’s decision as to actual travel dates is final and binding. Sponsor will attempt to accommodate each Winner’s preferred itinerary, but all specifics thereof will be at Sponsor’s discretion. If a potential Winner is unavailable to travel during designated timeframe for any reason, the Prize will be forfeited without compensation of any kind and an alternate Winner may be selected from among all remaining eligible entries in a random drawing. Travel must be reserved through Sponsor’s agent, and Sponsor will determine airline, hotel, flight and ground transportation itinerary in its sole discretion. Once hotel/cruise accommodations and flight arrangements have been confirmed, no changes will be allowed except by Sponsor. Vacation is for the respective Winner and up to three (3) guests of each Winner’s choosing. Once selected by a Winner, Guests cannot be changed without the express consent of Sponsor, which may be withheld for any reason.

Minors under the age of eighteen (18) not traveling with a parent or legal guardian must be accompanied by an adult over the age of twenty-one (21) in the same stateroom. The parent or guardian of any minor not traveling with a parent or guardian must appoint an adult to have custody and control over their minor and to contract on their behalf in connection with the Vacation. An appointment form will be included in the document package and must be signed by parent or legal guardian prior to embarkation at the Disney Cruise Line terminal.

Vacation fulfillment is subject to availability and restrictions. Travel may not occur during cruise ship or airline block-out periods. Vacation may not be sold, traded, transferred, refunded, commissioned or redeemed for cash value. Vacation elements may not be substituted and vacations are non-commissionable. Furthermore, Winner and Guests are solely responsible for providing proper citizenship documentation to travel which may include passports, valid alien registration card and/or necessary visas. Those without proper citizenship documentation will be denied boarding. It is the Guests’ responsibility to check with their travel agent, government agencies, embassies or consulates prior to their vacation to ensure that they have proper citizenship documentation. U.S. Citizens can also visit the State Department’s travel website at www.travel.state.gov, or call the U.S. National Passport Information Center at (877) 4USA-PPT for more information. Guests of all ages are strongly encouraged to obtain passports. Members of the Group are solely responsible for obtaining any and all necessary travel documents (valid photo I.D., passport, visa, credit card, etc.) before departure. Photo identification and credit card or cash deposit may be required at check-in for incidental charges (e.g., room service, use of telephone/IT services, laundry and all other optional extra services not provided in the Prize).

The Winner and Guests will be required to execute a liability/publicity release and waiver form prior to booking of any travel. The Winner and each Guest will also be required to sign the Disney Cruise Line cruise contract before embarkation (the “Cruise Contract”). The Cruise Contract is available at www.disneycruise.com/cruisecontract. Failure to return the executed release form or to accept and sign the Cruise Contract within the specified time periods will result in forfeiture of the Vacation. The Winner and Guests are required to comply with Disney Cruise Line’s health and safety measures and operational guidelines. Persons not meeting embarkation requirements will be denied boarding. Visit www.disneycruise.com/updates for the latest information. Health and safety measures and operational guidelines, ports of call and offerings may change at any time without notice. In the event the Winner and/or Guest(s) engage in behavior that, as determined by Sponsor in its sole discretion, is obnoxious or threatening, illegal, is intended to annoy, abuse, threaten or harass any other person, or is contrary to Disney Cruise Line’s health and safety protocols, rules or policies in effect at the time of the Vacation, Sponsor reserves the right to terminate the Vacation or other applicable experience early, in whole or in part, and send the Winner and/or Guest(s) home with no further compensation.  The Winner agrees to be solely responsible for any actions, claims or liabilities of any member of the Group, related to any use or misuse of the Vacation or any related activity or travel.

Certain Disney Cruise Line onboard venues, experiences and other offerings may be modified or unavailable, may have limited capacity and may be subject to limited availability, advance reservations or even closure.

Any and all costs or expenses not specifically mentioned herein are not included and are solely the Winner’s sole responsibility, including, but not limited to, round trip transportation between the Winner’s residence and the Departure Airport (if applicable), round-trip transportation between Winner’s residence and the hotel (if applicable), Winner’s transportation to the port of call (if applicable), alcoholic and non-alcoholic beverages, fax, food, gratuities and tips, insurance, laundry service, merchandise, parking, room service, service charges, excursions, souvenirs, spa services, ship to show communications (including internet), telephone calls and taxes which are not expressly included in the Vacation. Travel and lodging are subject to availability, certain restrictions, blockout dates and Sponsor’s approval as determined by Sponsor in its sole discretion. Hotel regulations and conditions apply. Sweepstakes Entities are not liable, including for any costs or expenses, Winner and Guest(s) (if a minor in his/her jurisdiction of residence, his/her parent or legal guardian) must sign a Release and Indemnification and a Publicity Release (where allowed by law), prior to issuance of travel documents, which must be returned with the verification documents requested of Winner, or guest portion of the Vacation will be forfeited. If the Winner chooses to bring less than the allotted number of Guests, the Prize will be awarded in increments suitable for the actual number of participants with no substitute prize or compensation provided to the Winner. Itineraries and departure dates may be changed, cancelled, discontinued, delayed or postponed at any time and without prior notice. Sponsor and Disney Cruise Line are not liable, including for any costs or expenses, if any component of the Vacation is changed, cancelled, discontinued, delayed or for any reason and Winner will not be reimbursed, and no substitution will be provided except as in Sponsor’s sole discretion. Sweepstakes Entities will not replace any lost, mutilated or stolen tickets, travel vouchers, gift cards or certificates. Prize will only be delivered to street address within the United States. Prize elements may not be separated. Prize cannot be used in conjunction with any other promotion or offer, and any unused element of the Prize will be forfeited. If any portion of the Prize is not available for any reason, then the Sponsor reserves the right to substitute that portion of the Prize with another prize of comparable or greater value. If the Group cannot comply with these restrictions or any other portion of these Official Rules, the Prize will be forfeited in its entirety and an alternate Winner may be chosen from among all eligible entries in a random drawing.

If Vacation includes airfare, the Winner and Guests must travel together on the same itinerary, and air transportation must be round-trip (with possible layovers) from/to the same Departure Airport/Arrival Airport (both as defined above), as chosen by Sponsor. Sponsor will determine airline and flight itinerary in its sole discretion. Airline carrier’s regulations and conditions apply to air travel. Airline tickets are nonrefundable, non-transferable, and are not valid for upgrades. Airline tickets are non-refundable and non-transferable. No refund or compensation will be made in the event of the cancellation or delay of any flight. Airline tickets issued in conjunction with the Prize are not eligible for frequent flyer miles, and no code share flights may be used. No one-way trips or upgrades allowed. Unless otherwise necessitated by Sponsor, no stopovers are permitted on tickets issued as the Prize; if a stopover otherwise occurs, the Prize will terminate and full fare will be charged from the stopover point for the remaining trip segment(s), including the return. Prize travel is subject to capacity controls, availability and certain other restrictions, which may include a Saturday night stay, all of which are subject to change. Airfare may not include government taxes, Passenger Facility Charge or September 11th Security Fee. Other travel restrictions and blackout dates may apply. All airline tickets are subject to the vagaries of flight variation, work stoppages, and schedule or route changes. Sponsor reserves the right to structure travel routes in its sole discretion. The roundtrip air transportation element of the Prize begins and ends at the point of departure. Other hotel fees are not included and if applicable may be payable at the time of check-out by the Winner/Guest(s).  Winner is solely responsible for any and all baggage charges, taxes and any other charges incurred after or in connection with the issuance of airline tickets. Sweepstakes Entities are not liable for any expenses incurred as a consequence of flight cancellation/delay.

Any images of prize/prize components in advertising are for illustrative purposes only and actual items awarded as prize/prize components may differ from such images; and, Sweepstakes Entities expressly disclaim any and all liability in conjunction therewith. 

All taxes (including, without limitation, U.S. federal, state and local taxes (including, but not limited to income and withholding taxes) and sales taxes as applicable on or connected with the Prize, the shipment of any Prize element, as applicable, and the reporting consequences thereof, and any other expenses not specifically included in the Prize description are the sole responsibility of the Winner. The Winner will receive an IRS Form 1099-MISC reflecting the total fair market value of the Prize. Non-residents of California are subject to the California withholding tax of 7% of the Prize value, when applicable.

8. WINNER NOTIFICATION: Potential winner will be notified by direct message from the Disney Account approximately one (1) business day following the end of the Promotion Period. It is recommended that you confirm your Instagram notification settings are turned on; it is your sole responsibility to configuring your Instagram privacy settings so that you are able to receive a direct message from the Disney Account. The initial verification notice (via Instagram direct message) will request that potential winner share specific personal information (e.g., full name, address, phone number, date of birth, Instagram username) within twenty-four (24) hours after the notice is sent. Failure to respond to the initial verification notice within twenty-four (24) hours after the notice is sent with all required information will result in disqualification. Potential winner will be required to sign and return, within three (3) business days of request by Administrator, an Affidavit of Eligibility, Release and Indemnification, a Publicity Release where allowed by law and W-9 Form (“Winner Documents”). If the completed Winner Documents are not returned by a potential winner to Sponsor within the specified time period, the potential winner may be disqualified. If potential winner is disqualified for any reason, the entrant will forfeit his/her status as a winner, without compensation of any kind and the prize will be awarded to alternate winner selected from all remaining non-winning eligible entries received during the Promotion Period.

In the event of any dispute concerning the identity of any entrant, the entry will be deemed submitted by the natural person who is the authorized account holder of the e-mail account corresponding to the Instagram account used for entry. "Authorized account holder" is defined as the natural person who is assigned to an e-mail address by an Internet access provider, online service provider, or other organization (e.g., business, educational institution, etc.) that is responsible for assigning e-mail addresses for the domain associated with the corresponding e-mail address and he/she must fully comply with these Official Rules.

9. CONDITIONS AND LIMITATIONS OF LIABILITY: By participating in this Sweepstakes, entrants agree to release and hold harmless Sweepstakes Entities, and each of their respective officers, directors, employees, agents and representatives and each of their respective successors, representatives and assigns, as well as Meta Platforms, Inc., (collectively, the "Released Parties") from any and all actions, claims, injury, loss or damage arising in any manner, directly or indirectly, from participation in this Sweepstakes and/or acceptance, receipt, possession or use/misuse of the prize/prize components. By entering, entrants also authorize the Sponsor and its designees to use their name, voice, likeness, photograph, prize information (if applicable), biographical data and city and state of residence in programming, advertising and/or promotional material or on a winner’s list (if applicable) without compensation to the extent permitted by law. Sponsor is not obligated to use any of the above mentioned information or materials, but may do so and may edit such information or materials, at Sponsor's sole discretion, without obligation or compensation. All federal, state and local laws and regulations apply. All content in Sweepstakes Entries become the property of the Sponsor.

Sponsor and its agencies are not responsible for failed, partial or garbled computer transmissions, or for technical failures of any kind affecting the Sweepstakes in any manner, including but not limited to electronic malfunction or damage of any network, hardware or software. If for any reason the Sweepstakes is not capable of running as planned, including infection by computer virus, bugs, tampering, unauthorized intervention, fraud or technical failures beyond Sponsor’s control that corrupt or affect the administration, security, fairness, integrity or proper conduct of the Sweepstakes (including entries or otherwise), Sponsor reserves the right, in its sole discretion, to disqualify any individual, whether or not the individual is a entrant in the Sweepstakes, who tampers with the entry process, and to terminate, modify or suspend the Sweepstakes. Sponsor assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or loss, destruction or unauthorized access to, or alteration of, entries; or any problems or technical malfunctions of any telephone network or lines, computer online systems, servers, or providers, computer equipment, software, failure of any e-mail or electronic entry or participation to be received on account of technical problems or traffic congestion on the Internet or at any website/platform, or any combination thereof, including any injury or damage to any individual’s computer related to or resulting from participation in or downloading any materials from this Sweepstakes. Failure of Sponsor or Administrator to enforce any provision of these Official Rules shall not constitute the waiver of such provision.

 

Entrants agree not to knowingly damage or cause interruption of the Sweepstakes and/or prevent others from participating in the Sweepstakes. CAUTION: ANY ATTEMPT TO DAMAGE ANY ONLINE SERVICE, WEBSITE OR PLATFORM OR UNDERMINE THE LEGITIMATE OPERATION OF THE SWEEPSTAKES VIOLATES CRIMINAL OR CIVIL LAWS. 10. DISPUTES: To the fullest extent permitted by law, entrant agrees that: (1) any and all disputes, claims and causes of action arising out of or connected with this Sweepstakes or the awarding of the Prize (including, without limitation, the Prize and/or its use thereof) shall be resolved individually, without resort to any form of class action, and exclusively by the Circuit Court of Orange County in the State of Florida (or if the Circuit Court does not have jurisdiction over the subject matter thereof, then to such other court sitting in such county having subject matter jurisdiction); (2) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this Sweepstakes, but in no event attorneys' fees; and (3) under no circumstances will entrant be permitted to obtain awards for, and entrant hereby waives all rights to claim, indirect, punitive, incidental and consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. SORTEO AL AZAR/SELECCIÓN DE GANADORES/PROBABILIDADES: El posible ganador del premio se seleccionará mediante un sorteo al azar aproximadamente un día hábil después de la fecha de finalización del Periodo de la Promoción, entre todas las participaciones elegibles recibidas durante dicho Periodo. Si el ganador reside fuera de un radio de 250 millas de Port Everglades:

 Una (1) habitación estándar con ocupación máxima para cuatro (4) personas en un hotel (el hotel se elige a discreción de Disney) durante una (1) noche antes de la salida del barco;

 Transporte terrestre para un máximo de cuatro (4) personas o vale(s) para el servicio de transporte terrestre local desde el aeropuerto de llegada al hotel, desde el hotel hasta Port Everglades y desde Port Everglades hasta el aeropuerto de llegada (a discreción de Disney);

El crucero de Disney Cruise Line constará de un (1) crucero de cuatro (4) o cinco (5) noches (la duración del crucero dependerá de la fecha de salida elegida) en el Disney Destiny para un máximo de cuatro (4) personas, que consta de:

 Un (1) camarote a bordo del Disney Destiny (ubicación/categoría a discreción exclusiva de Disney) con ocupación máxima para cuatro (4) personas;

El ganador debe proporcionar al Patrocinador tres (3) posibles fechas de viaje; sin embargo, la decisión del Patrocinador sobre las fechas de viaje es definitiva y vinculante. El Patrocinador intentará adaptarse al itinerario preferido de cada ganador, pero todos los detalles al respecto quedarán a su discreción. Si un posible ganador no está disponible para viajar durante el período designado por cualquier motivo, el premio se perderá sin compensación alguna y se podrá seleccionar un ganador alternativo entre todas las inscripciones elegibles restantes en un sorteo al azar. El viaje debe reservarse a través del agente del Patrocinador, y el Patrocinador determinará el itinerario de la aerolínea, el hotel, el vuelo y el transporte terrestre a su entera discreción. Una vez confirmado el alojamiento en el hotel/crucero y los arreglos de vuelo, no se permitirán cambios, excepto por parte del Patrocinador. Las vacaciones son para el ganador respectivo y hasta tres (3) invitados a elección de cada ganador. Una vez seleccionado por un ganador, los invitados no se podrán cambiar sin el consentimiento expreso del Patrocinador, que podrá denegarse por cualquier motivo.

Los menores de dieciocho (18) años que no viajen con sus padres o tutores legales deberán estar acompañados por un adulto mayor de veintiún (21) años en el mismo camarote. El padre o tutor de cualquier menor que no viaje con sus padres o tutores legales deberá designar a un adulto para que tenga la custodia y control del menor y para que firme el contrato en su nombre en relación con las Vacaciones. Se incluirá un formulario de designación en el paquete de documentos, que deberá ser firmado por el padre o tutor legal antes del embarque en la terminal de Disney Cruise Line.

El cumplimiento de las vacaciones está sujeto a disponibilidad y restricciones. No se podrá viajar durante los períodos de bloqueo de cruceros o aerolíneas. Las vacaciones no se podrán vender, intercambiar, transferir, reembolsar, comisionar ni canjear por dinero en efectivo. Los elementos de las vacaciones no se podrán sustituir y las vacaciones no están sujetas a comisiones. Además, el Ganador y sus Invitados son los únicos responsables de proporcionar la documentación de ciudadanía correspondiente para viajar, que puede incluir pasaportes, tarjeta de registro de extranjero válida o las visas necesarias. Se denegará el embarque a quienes no tengan la documentación de ciudadanía correspondiente. Es responsabilidad de los Huéspedes consultar con su agente de viajes, agencias gubernamentales, embajadas o consulados antes de sus vacaciones para asegurarse de contar con la documentación de ciudadanía vigente. Los ciudadanos estadounidenses también pueden visitar el sitio web de viajes del Departamento de Estado en www.travel.state.gov o llamar al Centro Nacional de Información sobre Pasaportes de EE. UU. al (877) 4USA-PPT para obtener más información. Se recomienda encarecidamente a los Huéspedes de todas las edades que obtengan pasaporte. Los miembros del Grupo son los únicos responsables de obtener todos los documentos de viaje necesarios (identificación con foto válida, pasaporte, visa, tarjeta de crédito, etc.) antes de la salida. Es posible que se requiera una identificación con foto y un depósito con tarjeta de crédito o en efectivo al momento del check-in para cubrir cargos adicionales (por ejemplo, servicio de habitaciones, uso de servicios telefónicos/informáticos, lavandería y cualquier otro servicio adicional opcional no incluido en el Premio).

El Ganador y sus Invitados deberán firmar un formulario de exención de responsabilidad/publicidad antes de reservar cualquier viaje. El Ganador y cada Invitado también deberán firmar el contrato de crucero de Disney Cruise Line antes del embarque (el "Contrato de Crucero"). El Contrato de Crucero está disponible en www.disneycruise.com/cruisecontract. Si no se devuelve el formulario de exención firmado o no se acepta y firma el Contrato de Crucero dentro de los plazos especificados, se perderán las Vacaciones. En caso de que el Ganador y/o su(s) Invitado(s) presenten un comportamiento que, a criterio exclusivo del Patrocinador, sea desagradable o amenazante, ilegal, tenga como objetivo molestar, abusar, amenazar o acosar a cualquier otra persona, o sea contrario a los protocolos, normas o políticas de salud y seguridad de Disney Cruise Line vigentes al momento de las Vacaciones, el Patrocinador se reserva el derecho de cancelar anticipadamente las Vacaciones u otra experiencia aplicable, total o parcialmente, y enviar al Ganador y/o su(s) Invitado(s) a casa sin ninguna compensación adicional. El Ganador acepta ser el único responsable de cualquier acción, reclamación o responsabilidad de cualquier miembro del Grupo, relacionada con el uso o mal uso de las Vacaciones o cualquier actividad o viaje relacionado.

Ciertos lugares, experiencias y otras ofertas a bordo de Disney Cruise Line podrían modificarse o no estar disponibles, tener aforo limitado y estar sujetos a disponibilidad limitada, reservas anticipadas o incluso al cierre.

Todos los costos o gastos no mencionados específicamente en este documento no están incluidos y son responsabilidad exclusiva del Ganador, incluyendo, entre otros, el transporte de ida y vuelta entre su residencia y el Aeropuerto de Salida (si corresponde), el transporte de ida y vuelta entre su residencia y el hotel (si corresponde), el transporte del Ganador al puerto de escala (si corresponde), bebidas alcohólicas y no alcohólicas, fax, comida, propinas, seguros, servicio de lavandería, mercancía, estacionamiento, servicio de habitaciones, cargos por servicio, excursiones, souvenirs, servicios de spa, comunicaciones entre el barco y el espectáculo (incluyendo internet), llamadas telefónicas e impuestos que no estén expresamente incluidos en las Vacaciones. El viaje y el alojamiento están sujetos a disponibilidad, ciertas restricciones, fechas bloqueadas y la aprobación del Patrocinador, según lo determine este a su entera discreción. Se aplican las regulaciones y condiciones del hotel. Las Entidades del Sorteo no son responsables, ni de ningún costo ni gasto. El Ganador y sus Invitados (si es menor de edad en su jurisdicción de residencia, su padre, madre o tutor legal) deben firmar una Exención de Responsabilidad e Indemnización y una Autorización de Publicidad (cuando lo permita la ley) antes de la emisión de los documentos de viaje, que deben devolverse junto con los documentos de verificación solicitados al Ganador; de lo contrario, perderá la parte de las Vacaciones destinada a los invitados. Si el Ganador decide traer menos Invitados de los asignados, el Premio se otorgará en incrementos adecuados al número real de participantes, sin que se le proporcione un premio sustituto ni compensación alguna. Los itinerarios y las fechas de salida pueden modificarse, cancelarse, interrumpirse, retrasarse o posponerse en cualquier momento y sin previo aviso. El Patrocinador y Disney Cruise Line no son responsables, ni de ningún costo ni gasto, si algún componente de las Vacaciones se modifica, cancela, interrumpe o retrasa por cualquier motivo, y el Ganador no recibirá ningún reembolso ni se proporcionará ninguna sustitución, salvo a discreción exclusiva del Patrocinador. Las Entidades del Sorteo no reemplazarán boletos, vales de viaje, tarjetas de regalo ni certificados perdidos, dañados o robados. El premio solo se entregará a domicilio dentro de Estados Unidos. Los elementos del premio no pueden separarse. El premio no puede utilizarse junto con ninguna otra promoción u oferta, y cualquier elemento no utilizado se perderá. Si alguna parte del premio no está disponible por cualquier motivo, el Patrocinador se reserva el derecho de sustituirla por otra de valor comparable o superior. Si el Grupo no cumple con estas restricciones o cualquier otra parte de estas Reglas Oficiales, el premio se perderá en su totalidad y se podrá elegir un ganador alternativo entre todas las participaciones elegibles en un sorteo al azar.

Si las Vacaciones incluyen pasaje aéreo, el Ganador y sus Invitados deben viajar juntos en el mismo itinerario, y el transporte aéreo debe ser de ida y vuelta (con posibles escalas) desde/hasta el mismo Aeropuerto de Salida/Aeropuerto de Llegada (ambos como se definen anteriormente), según lo elegido por el Patrocinador. El Patrocinador determinará la aerolínea y el itinerario del vuelo a su entera discreción. Las regulaciones y condiciones de la aerolínea aplican a los viajes aéreos. Los boletos de avión no son reembolsables, intransferibles y no son válidos para mejoras. Los boletos de avión no son reembolsables ni transferibles. No se realizará ningún reembolso o compensación en caso de cancelación o retraso de cualquier vuelo. Los boletos de avión emitidos junto con el Premio no son elegibles para millas de viajero frecuente, y no se pueden utilizar vuelos de código compartido. No se permiten viajes de ida ni mejoras. A menos que el Patrocinador lo requiera de otra manera, no se permiten escalas en los boletos emitidos como el Premio; Si se realiza una escala, el Premio se cancelará y se cobrará la tarifa completa desde el punto de escala para el/los segmento(s) de viaje restantes, incluido el regreso. El viaje del Premio está sujeto a controles de capacidad, disponibilidad y otras restricciones, que pueden incluir una noche de sábado, todas sujetas a cambios. Es posible que el precio del boleto aéreo no incluya impuestos gubernamentales, Cargo por Uso de Instalaciones para Pasajeros ni la Tarifa de Seguridad del 11 de septiembre. Pueden aplicarse otras restricciones de viaje y fechas restringidas. Todos los boletos de avión están sujetos a variaciones de vuelo, paros laborales y cambios de horario o ruta. El Patrocinador se reserva el derecho de estructurar las rutas de viaje a su entera discreción. El transporte aéreo de ida y vuelta del Premio comienza y termina en el punto de salida. Las Entidades del Sorteo no se hacen responsables de ningún gasto incurrido como consecuencia de la cancelación o retraso del vuelo.

Cualquier imagen del premios o componentes de premios en la publicidad son solo para fines ilustrativos y los artículos reales otorgados como premio o componentes de premio pueden ser diferentes de dichas imágenes; además, las Entidades del Sorteo renuncian expresamente a toda responsabilidad relacionada con ello.

Todos los impuestos (incluidos, entre otros, los impuestos federales, estatales y locales de EE. UU., incluidos, entre otros, los impuestos sobre la renta y las retenciones en la fuente) y los impuestos sobre las ventas aplicables al Premio o relacionados con él, el envío de cualquier elemento del Premio, según corresponda, y sus consecuencias para la declaración, así como cualquier otro gasto no incluido específicamente en la descripción del Premio, son responsabilidad exclusiva del Ganador. El Ganador recibirá un Formulario 1099-MISC del IRS que refleja el valor justo de mercado total del Premio. Los no residentes en California están sujetos a la retención en la fuente de California del 7 % del valor del Premio, cuando corresponda.

8. NOTIFICACIÓN AL GANADOR: El ganador potencial será notificado por mensaje directo desde la Cuenta Disney aproximadamente un (1) día hábil después de la finalización del Período de la Promoción. Se recomienda que confirme que la configuración de notificaciones de Instagram esté activada; es su exclusiva responsabilidad configurar la privacidad de Instagram para poder recibir un mensaje directo de la Cuenta Disney. El aviso de verificación inicial (a través del mensaje directo de Instagram) solicitará que el ganador potencial comparta información personal específica (por ejemplo, nombre completo, dirección, número de teléfono, fecha de nacimiento, nombre de usuario de Instagram) dentro de las veinticuatro (24) horas posteriores al envío del aviso. Si no responde al aviso de verificación inicial dentro de las veinticuatro (24) horas posteriores al envío del aviso con toda la información requerida, resultará en la descalificación. El ganador potencial deberá firmar y devolver, dentro de los tres (3) días hábiles posteriores a la solicitud del Administrador, una Declaración Jurada de Elegibilidad, Exención e Indemnización, una Autorización de Publicidad cuando lo permita la ley y el Formulario W-9 ("Documentos del Ganador"). Si un posible ganador no devuelve al Patrocinador los Documentos del Ganador completos dentro del plazo especificado, podrá ser descalificado. Si el posible ganador es descalificado por cualquier motivo, perderá su condición de ganador, sin compensación alguna, y el premio se otorgará a un ganador suplente seleccionado entre todas las participaciones elegibles no ganadoras restantes recibidas durante el Periodo de la Promoción.

En caso de disputa sobre la identidad de un participante, la participación se considerará enviada por la persona física titular autorizada de la cuenta de correo electrónico correspondiente a la cuenta de Instagram utilizada para la participación. "Titular autorizado de la cuenta" se define como la persona física a la que un proveedor de acceso a internet, un proveedor de servicios en línea u otra organización (por ejemplo, una empresa, una institución educativa, etc.) le asigna una dirección de correo electrónico, responsable de asignar direcciones de correo electrónico para el dominio asociado a la dirección correspondiente, y deberá cumplir íntegramente con estas Reglas Oficiales.

9. CONDICIONES Y LIMITACIONES DE RESPONSABILIDAD: Al participar en este Sorteo, los participantes acuerdan eximir de responsabilidad a las Entidades del Sorteo, a cada uno de sus respectivos funcionarios, directores, empleados, agentes y representantes, y a cada uno de sus respectivos sucesores, representantes y cesionarios, así como a Meta Platforms, Inc. (en conjunto, las "Partes Exoneradas"), de cualquier acción, reclamación, lesión, pérdida o daño que surja de cualquier manera, directa o indirectamente, de la participación en este Sorteo y/o de la aceptación, recepción, posesión o uso/mal uso del premio/componentes del premio. Al participar, los participantes también autorizan al Patrocinador y a sus designados a utilizar su nombre, voz, imagen, fotografía, información del premio (si corresponde), datos biográficos y ciudad y estado de residencia en la programación, publicidad y/o material promocional, o en la lista de ganadores (si corresponde), sin compensación, en la medida permitida por la ley. El Patrocinador no está obligado a utilizar la información ni los materiales mencionados anteriormente, pero podrá hacerlo y editarlos a su entera discreción, sin obligación ni compensación. Se aplican todas las leyes y regulaciones federales, estatales y locales. Todo el contenido de las participaciones en el sorteo será propiedad del Patrocinador.

El Patrocinador y sus agencias no se responsabilizan de transmisiones informáticas fallidas, parciales o ilegibles, ni de fallos técnicos de ningún tipo que afecten al Sorteo de cualquier manera, incluyendo, entre otros, mal funcionamiento electrónico o daños en la red, hardware o software. Si por cualquier motivo el Sorteo no puede desarrollarse según lo previsto, incluyendo infecciones por virus informáticos, errores, manipulación, intervención no autorizada, fraude o fallos técnicos ajenos al Patrocinador que corrompen o afecten la administración, seguridad, imparcialidad, integridad o correcta gestión del Sorteo (incluyendo participaciones o cualquier otro motivo), el Patrocinador se reserva el derecho, a su entera discreción, de descalificar a cualquier persona, sea o no participante del Sorteo, que altere el proceso de participación, y de cancelar, modificar o suspender el Sorteo. En tal caso, el Patrocinador se reserva el derecho de llevar a cabo el Sorteo y otorgar el/los premio(s) de forma justa, apropiada y conforme a estas Reglas Oficiales, según lo determine el Patrocinador a su entera discreción. El aviso de terminación, modificación o suspensión del Sorteo se publicará en la Cuenta Disney. El Patrocinador no asume ninguna responsabilidad por errores, omisiones, interrupciones, eliminaciones, defectos, demoras en la operación o transmisión, fallas en las líneas de comunicación, robo o pérdida, destrucción, acceso no autorizado o alteración de las participaciones; ni por problemas o fallas técnicas de redes o líneas telefónicas, sistemas informáticos en línea, servidores o proveedores, equipos informáticos o software; ni por la imposibilidad de recibir correos electrónicos o participaciones electrónicas debido a problemas técnicos o congestión de tráfico en internet o en cualquier sitio web o plataforma, o cualquier combinación de estos, incluyendo cualquier daño o lesión a la computadora de cualquier persona relacionada o resultante de la participación o descarga de materiales de este Sorteo. El incumplimiento por parte del Patrocinador o del Administrador de alguna disposición de estas Reglas Oficiales no constituirá una renuncia a dicha disposición.

Los participantes se comprometen a no dañar ni interrumpir el Sorteo a sabiendas, ni impedir la participación de otros. ADVERTENCIA: CUALQUIER INTENTO DE DAÑAR CUALQUIER SERVICIO EN LÍNEA, SITIO WEB O PLATAFORMA, O DE SOCAVAR EL FUNCIONAMIENTO LEGÍTIMO DEL SORTEO, INFRACTA LAS LEYES PENALES O CIVILES. EN CASO DE TAL INTENTO, EL PATROCINADOR PODRÁ DESCALULICAR A CUALQUIER PERSONA, SEA O NO PARTICIPANTE EN EL SORTEO, Y RECLAMAR UNA INDEMNIZACIÓN POR DAÑOS Y PERJUICIOS EN LA MAYOR MEDIDA DE LA LEY.

EL PATROCINADOR NO OFRECE NINGUNA GARANTÍA, REPRESENTACIÓN O GARANTÍA, EXPRESA O IMPLÍCITA, DE HECHO O DE DERECHO, RELACIONADA CON EL USO DE CUALQUIER PREMIO, INCLUYENDO, SIN LIMITACIÓN, SU CALIDAD, COMERCIABILIDAD O IDONEIDAD PARA UN PROPÓSITO PARTICULAR.

10. DISPUTAS: En la medida máxima permitida por la ley, el participante acepta que: (1) todas y cada una de las disputas, reclamaciones y causas de acción que surjan de o estén relacionadas con este Sorteo o la adjudicación del Premio (incluido, sin limitación, el Premio y/o su uso del mismo) se resolverán individualmente, sin recurrir a ninguna forma de demanda colectiva, y exclusivamente por el Tribunal de Circuito del Condado de Orange en el Estado de Florida (o si el Tribunal de Circuito no tiene jurisdicción sobre el objeto del mismo, entonces a dicho otro tribunal con sede en dicho condado que tenga jurisdicción sobre el objeto); (2) todas y cada una de las reclamaciones, sentencias y laudos se limitarán a los costos reales de bolsillo incurridos, incluidos los costos asociados con la participación en este Sorteo, pero en ningún caso los honorarios de los abogados; y (3) bajo ninguna circunstancia se permitirá al participante obtener premios por, y el participante por la presente renuncia a todo derecho a reclamar, daños indirectos, punitivos, incidentales y consecuentes y cualquier otro daño, excepto por gastos reales de bolsillo, y a todo derecho a que los daños se multipliquen o aumenten de otra manera. Todas las cuestiones y preguntas relacionadas con la construcción, validez, interpretación y aplicabilidad de estas Reglas Oficiales, o los derechos y obligaciones del participante y el Patrocinador en relación con el Sorteo se regirán e interpretarán de acuerdo con las leyes del Estado de Florida, sin dar efecto a ninguna elección de ley o conflicto de leyes (ya sea del Estado de Florida o de cualquier otra jurisdicción), que causaría la aplicación de las leyes de cualquier jurisdicción distinta a la del Estado de Florida.
